How does Mark Monitor Reports Work?

Hollander and Company LLC searches a proprietary database of millions of domain names from all generic top-level domains (gTLDs) (i.e., .com, .org, .net, .biz, .us, .info, etc.) including country code top-level domains (ccTLDs), and Web site home pages. Hollander and Company LLC finds Web sites that have incorporated your company name, product, brand or trademarks within the site's domain name or underlying HTML code, and delivers comprehensive reports of potential brand abuses in near-real time.

The free "Size the Problem" report quantifies sites using your search term in domain names (Cybersquatting) or on home pages (Brand Abuse). If the number of instances exceeds what you know your company controls, you should then purchase a report. You can choose from a Cybersquatting report (which will tell you exactly which websites have your search term or company name in their domain name and the registrant's contact information), a Brand Abuse report (which identifies which homepages have your search term, where it is hidden, and the registrant's contact information) or the Combination report (provides you both Cybersquatting and Brand Abuse reports). You can then download these results, and prioritize which Web sites require follow-up action.

Armed with this critical intelligence, you can proactively protect your online marketing and brand presence, and put a stop to trademark infringements, traffic diversion, customer confusion, and lost revenues.

. . .

Why should I care?

If a thief broke into your company at night and stole cash out of your register, YOU WOULD CARE! Online brand abuse can have the same economic impact. If customers trying to find your company on the Internet are diverted or tricked into visiting a competitors website, YOU are losing money. Here are examples of cybersquatting and brand abuse that Hollander and Company uncovered:

  • High-end stereo components company finds websites selling their products illegally online
  • Hotels identified competitors' websites using traffic diversion to steal their customers and revenues
  • Children's educational company found cybersquatters hosting pornographic sites targeting kids

Other examples of business issues resulting from online brand abuse:

  • Traffic Diversion - Lost site traffic, and ultimately lost revenues, due to traffic diversion schemes used by competitors and predators, including unauthorized brand use in domain names, site titles, meta tags, links, logos, visible and hidden text.
  • Reputation Damage and Trademark Dilution - Damage to brand equity and corporate identity through negative brand association with objectionable content (hate sites, pornography, gambling, violence, etc.).
  • Vanity Information - Find out what is being said about you, your company, and your products.
  • Counterfeiting - Is someone selling online counterfeits of your products? Is your intellectual property being sold online? Are your digital assets being stolen? Do you require certifications or licensing fees before your name or product can be used?
  • Illegal Distribution - Are your products being sold without your knowledge or authorization?
  • Competitive Intelligence - How are your competitors branding their products and services on the Web? What websites are they using? Where are they advertising? Find out strategic competitive information quickly and affordably.

. . .

What can I do to protect my brand names?

Gain awareness: To help you understand the potential scope of your brand abuse problem, Hollander and Company provides a free Size the Problem Report. This report quantifies the number of sites and categories in which your brands are being potentially abused.

Get the Facts: After Hollander and Company LLC determines the scope of potential brand abuse, you can purchase additional reports that provide detailed information about the sites using or subverting your brands. With this information, you will know which sites are abusing your company online, how they are perpetrating the abuse, and additional information about each site (e.g., is the site live or parked; is the sie e-commerce enabled?).
This information will help determine if additional action is required.

Obtain Legal Expertise: Once you determine which sites are leveraging your brand and potentially stealing your assets, you can click on the Legal Resources button for a listing of Intellectual Property and Trademark professionals. While we do not explicitly endorse this list, all of these IP attorneys are current Premium Legal Members of BulkRegister and can provide whatever services are required to stop online infringements.

. . .

What does a detailed report tell me that a search engine can't?

While a free report will only tell you the number of sites that infringe on your brand, a full detailed report gives you much more information than a search engine ever could for a number of reasons. The best way to put it is that a search engine like Google searches DEEP and in the process, produces lots of irrelevant detail by searching words together and separately. Hollander and Company LLC searches broadly and provides much greater relevancy by searching words together (just like your trademarks and company names are used) and by searching only home pages, where the most relevant examples of abuse can be found.

In addition, our report is more thorough. The best search engines only search a quarter of the Internet - as in 25% - while Hollander and Company LLC searches 100%, including ccTLDs. Search engines do not search domain names, for cybersquatting, and they do not give WHOIS information of the offending registrant. Hollander and Company LLC does - which allows you to define the location of the abuse, download or sort results and take fast action.

Using a search engine to find examples of brand abuse or cybersquatting takes days, even weeks, and is an impossible task. Hollander and Company LLC takes less than five minutes and gives you the information you need to take action immediately. You have the exact Name and Adress of the abuser and a Sample Cease and Desist letter which you can send in a matter of hours. Some users simply download the results and do a one shot mailing to the people stealing their business and revenue.

. . .

What information is provided in the free report?

FREE Brand Abuse Analysis: Gives a total number of instances found and then breaks out by percentage the different areas on homepages throughout the Internet that contain your search term and represent possible abuse: text, links, meta, image, title.

FREE Cybersquatting Analysis: Gives a total number of instances found and then breaks out by percentage domain names containing your search term in the various TLDs com, net, org, and ccTLDs.

. . .

We have been very fortunate to be represented by Hollander and Company LLC when it came time to trademark our company name. Their attention to detail was useful to us in helping clarify exactly what it was we were doing and what to expect. Also Jay Hollander was always sure to keep us up to date on what was happening. In this day when you hear horror stories about attorneys never following up it's good to know you've got someone on your team that you can trust.

Mr. Hollander consistently worked with my interests in mind, and often juggled his calendar around to accommodate meetings. He checks his email, voicemail, and responds during hours when most attorneys wouldn’t.

I would like to thank you personally for the excellnt Lan Management contract review, which you recently completed for us. It brought to light many issues that might have gone unnoticed if we had taken the path we pursued on a prior software management agreement. In today's Software and Services market it is imperative that the right Legal firm with the right experience review your contract before you sign on the dotted line. In closing I would like to say I really appreciated your efforts and attention to detail.
Michael A. Ritholz - Data Processing Manager - Borah, Goldstein, Altschuler, Schwartz & Nahins, P.C.

I will be more than happy to recommend your services to anyone looking for assistance in this area.
